There are two important aspects to the procedural errors made by judge Du in this case.
1. the weighing the S.C. against each other is a clear error with no prior case law to support it.
2. The acceptance of prima facie evidence before turning attention to S.C. is clear error
3. Both these errors were critical factors in determining the decision of the invalidity of Amarin's patents.

Either one of these errors were sufficient cause for reversal, even without factoring in the errors in Mori and Kura.
