judge Du and the appeals judges can and will differ on what is "clear and compelling" on Mori, Kura, prima facie, USPTO considerations(CITATIONS),strength or weakness of positive vs. negation S.C..... but one thing they should not disagree on...is the weighing of negative vs. positive S.C. for which there is NO CASE LAW....if the S.C. were of little importance to the case, THEN WHY WOULD JUDGE DU WEIGH NEGATIVE VS. POSITIVE S.C.?

apparently "clear and compelling" did not have much meaning for judge Du in this case...but neither did previous case law.
