yes indeed, I'm certain a multitude of defendants wake up in a sweat in the middle of the night with that exact discombobulation plaguing their psyches.
Hindsight is 20/20.. .pay now $5 million when/where one does not think it's a problem ..or later face $1+ billion price tag when the courts deem it's a definite problem.
