It’s a good point you bring up that was mentioned by Du.

However we all know every TG drug raised LDL in severely high TG population so that population in and of itself acted differently with respect to LDL. Yes it was obvious TG would be reduced with TG<500 or Tg> 500 but she makes the leap to assume that there is no evidence to suggest LDL would be any different in those populations which is in direct contraindication to expert testimony. Furthermore, she completely leaves out the mechanism of action in her decision which is crucial to the case and outlines why in populations with severely high TG it was well known that reducing the TG would lead to an increase in LDL. I think that has to be addressed in appeal and won’t be easy for generics to argue against. Looking forward to the reply brief. I know it’s going to be ugly but we will have our chance to argue back.
