Wu and Waske are just delaying the Closing of the POR.. their case is not going to win.

The placement of claim by the trust on 10-B is correct.. The trust is claiming a subordinated debt that was issued by LBHI to the trust.
LBHI guarantee is just in the background but still existing as an equity claim.. just like any preferred.
