Judge Du, during the course of the case, said that, while the USPTO had eventually approved the Marine patent,the USPTO had NOT considered Mori...when they actually had...this was a clear error,leading judge Du, not only to discount the two population error in Mori and the APO error in Kura...but in motivating her to base her case on faulty prima facie evidence...an error, which she continued with...right into her decision on weighing secondary considerations to build her case.

If the prima facie case was in error..then Judge Du' decision was in error...even without the error of weighing negative vs. positive secondary considerations.
