There is zero, literally zero evidence that the generics would not settle. Pure speculation.

In fact, the evidence is to the contrary. All of the parties were compelled to attend an in-person settlement conference with the Magistrate Judge, where they were also ordered to provide written settlement statements detailing the basis for their respective settlement positions.

It is possible that the generics treated it like a joke, and wrote up a lawyerly document that said nothing and took a ridiculous position. But there has been no publicly disclosed confirmation of that actually happening.

Without transparency and disclosure, nobody can confirm the truth of the parties' respective settlement positions. Given that the stock price has fallen 74% off its post-FDA approval high, it is difficult to believe that any settlement could have possibly been worse than the current debacle. The complete lack of transparency leads me to further believe that Amarin could have reasonably settled, but instead, recklessly gambled the entire company with disastrous results.

I would be more than happy to be proven wrong in this conclusion through the disclosure of genuine evidence indicating that settlement was literally impossible.
