Ok, well, what do you think about the "clear" factual errors Singer cites in his briefs -- things like the Judge saying the examiner didn't review Mori or Karabayashi when he did, or the fact that the "praise" for MARINE had "caveats" that the praiser was just waiting for peer review of the results, or that Du agreed with the defendants mistaken interpretation of the Karabayashi results (chopped off chart) -- saying there was a difference between EPA and DHA when statistically there wasn't?

It's a BIG question as to whether these unquestionable errors are "clearly erroneous". When does the appeals court step in on these things -- how bad does it have to get until the line is crossed?

I guess that's the $64 billion dollar question.
