I just read the Singer brief word for word AGAIN.

It is just devastating. I have been looking for holes in it. I really can't find any. Maybe one could quibble that the examiner's prima facie stance on Mori doesn't constitute "no evidence" -- I think there is no obstacle to the district court judge noting that -- but that is literally the only quibble I can locate. Everything else is clear, direct and airtight.

I have absolutely NO IDEA what the retort to this brief could be, but I guess we will see that soon enough.
