However, if we end up with liberal Judges, Singer will magnify Amarin's stature against all odds, as "the little engine that could.".

Well … I do not think the mix of the 3 judges will matter. "Prima facie" vs "totality" approach is the weakest / most irrelevant part of the appeal.

I mean: if the other parts will stand the reversal will be granted (as "prima facie" also) … if will not stand, "totality" will not save the case.
