Factual errors can be considered and corrected by the CAFC, but yeah, they do have the ability to defer to Du's judgement if they desire. If I were one of the appeals judges I could not let a clearly serious factual error go uncorrected (I'm anal about that stuff), and what Singer brings up isn't even close to falling into a grey area where deference might be the path I'd take.
