Irish-I do think the FDA cares if generics could meet demand for many reasons.

First and foremost, the FDA is responsible for the quality and quantity of EVERY drug they approve. wholesalers will be dependent on receiving their orders for needed customers (at the generic price) and the FDA must be sure that the generics will deliver. Second, once the generics move in, the brand co. limits its production significantly.

For me something has changed. Was hoping the approval would come around later in process (after generics submit their papers--and we are very confident in a win...).

I agree, the most important is the price in Dec./Jan. after the verdict, but if we lose the injunction the sp will be lower and after we win the appeal it might not jump as high as it should.

After thinking it over--If I were HIKMA I would launch--it gives me better leverage in settl. and for the appeal--judges might not want to stop the generics once they started.
