I have actually edited the memo, and condensed it into the appropriate complaint format, which I will be filing with the Judicial Council of the Ninth Circuit tomorrow.

This is a completely separate matter than the appeal. There is no overlap other than referencing the appeal in my papers.

While I would highlight the article in my reply if I was the attorney, I can totally see the wisdom of Singer/Amarin ignoring it and staying laser focused on the technical issues. In other words, in this highly technical court of special jurisdiction, some of the more bombastic tactics we might employ in other courts, may not be most prudent here.
