Based on what you read in Du's bench order, did the defendants accomplish that?

I did not finished my DD on the Order / Appeal / Opening brief … but I mentioned: meanwhile I did not think that HTG vs VHTG will be discussed … Singer made an excellent (brilliant) call … constructed the issue as a procedural error instead of factual (that could be a subject of deference). More later.
