Legal question:

Amarin appealed the district court ruling with points ABC. When Generics reply, must their reply SPECIFICALLY ADDRESS each one of those points or can they create new points (XYZ) to argue their position?

If Generics do not address ABC, does that mean that judges should accept ABC as true because Generics did not contest them?

The reason why I am asking this is because IMO some points that Singer made cannot be argued; he is correct about them, they are black & white. If that is the case, will the Generics try to address them specifically or will they bring up XYZ instead?
