Anyone, including private citizens can file an amicus brief. Why not do that JL? There might be some good reasons not to as well. Some judges think they are needless ways of increasing the volumes of appellants own briefs and just serve to be counterproductive. In this case I think JL's expounding of the Friedwald Equation adds value to the obviousness question.
