Those arguments shooting down the possibility of a settlement or that it would be beneficial to Amarin, as exemplified by Raf's post from this morning, are well taken. I do not have sufficient knowledge to decisively refute those positions.

My own view is that I am reluctant to conclude that settlement is impossible or non-beneficial to Amarin without having access to all of the facts available to JT, and the rest of his decision-making team.

We are totally in the dark as to how close they ever came to settlement, or if they are even talking. While the arguments based upon what is known, that a settlement would not be beneficial to Amarin, are strong, I will not discount the possibility that based upon internal numbers crunching by professionals with that kind of expertise, that a path to settlement does not exist.
