App. statement emphasizes "binding precedent", indicates focus of appeal is on PROCEDURAL errors of (1) analyzing sec. cons. AFTER a finding of primary facie of obviousness; and (2) negating the 2 sec. cons. that favored amrn by other sec. cons. that were lacking.

Does not sound that Singer will try to convince 3 judges, w/out science backgrounds the intricacies of chem. statistics, hence will not discuss Kurabayashi issue (which even Markman feels is not productive, since other p/a is against us).

The "factual error" mentioned in the statement probably indicates that Singer will discuss Mori, showing that study was diff. than our case and how it wasn't obvious to all pharm co. that A+B =C back then.
