I see it differently. I see them saying that because the only issue is whether the generics can launch, and because the case does not involve damages, the case is not appropriate for mediation. I think that is hardball approach, because there are still a whole potpurri of settlement possibilities, and the fact that this is not a damages case, is irrelevant.
