rel-yes, yet USPTO was correct to weigh the sec. cons. AFTER it conducted the prima facie obviousness analysis--however many/most ct hold that the sec. cons. must be evaluated TOGETHER with the prima facie analysis. This is one of Du's possible procedural mistakes that will cause AMRN to win appeal.
