Also there are hundreds of statement of facts that are dubious at best (which the lawyers probably did their best to refute). Covington had no idea that DU would use THIS particular statement of fact to make her decision, one that seems oddly weak.

AMRN did submit documents that refuted this fact - if even Markman with a passing interest, who isn't getting paid $ for this case can see that, why couldn't the judge, whose ONLY JOB is to listen to the facts and decide on the case and is paid a hefty wage by taxpayers to do so? She doesn't check her work?
