Regarding court of appeals...it’s from the beginning. It’s only what it is the record. If AMRN cited kurabyashi article and referenced... that’s in the record. Should be allowed as a point of contention given the decision was based on an incomplete table....of this can’t be argued....what the hell world are we living in?

I believe the weighing of secondary considerations against one another is the absolute reason we will prevail. It’s all about what judges we get....but even that is sad....it either is the wrong way to do it or it’s not. Should not have to rely on another roll of the dice.....my greatest consolation is that appeals court judges are smarter than me. And for that I am thankful and hopeful for.
