Agree that the disconnect between Judge Du’s opinion - “. . . the Patent Office’s examiner did not consider Kurabayashi” and Amarin’s statement in Findings of Fact - “Kurabayashi was considered by the United States Patent and Trademark Office during prosecution of the Asserted Patents”, is curious and potentially significant, as the addition of another valid secondary consideration would be very meaningful on appeal. It would also represent an important factual error on the part of the district court.
