Think about this for a minute. We all had good reason to believe that the outcome would be different. Most analysts did, all attorneys surveyed by analysts did and of course the stakeholders did. What the heck happened? The exact opposite. The world as we knew it suddenly changed.
I don’t know if Judge Du is right in her decision. For all I know she could have based it on a deeply held view of the industry and not on the law. Again, I don’t know. That will be sorted out. However, what we must concern ourselves with is this fact: the wonder drug, this life saving discovery is now headed for storage in that very large warehouse we all remember seeing at the conclusion of the RAIDERS OF THE LOST ARK. It will be lost forever if the generics conclusively win.
