Thank you for sharing your view.

since overturning for obviousness requires "clear and convincing evidence" standards, does the evidence being considered to rule on obviousness (regardless of the strength of the argument) rise to that standard? Ie. does the one study her ruling is mostly based on (Mori) raise to that standard?

The other question that I have is the following:
Du has failed to consider in her argumentation that the totality of the body of evidence points to different expectations re LDL increase in different populations (severe hypertrigliceridemia vs non-severe). Again: regardless of her argument (basically pointing to a hypotethical reasonable expectation of success by a POSA by extrapolating clinical behavior in different clinical populations - which is scientifically unsound), but the fact that she simply ignores the body of evidence presented in her ruling (material facts), would that not also be material for appeal?
