So some facts as we know them now.

JT issues statement “we intend to fight, litigate, believe in the IP”

Amrn is/will rethink US strategy pending assumptions of injunction (up to 2 weeks)

Generics likely have API/manufacturing issues would prefer entry until market much bigger/aNDA entry

*****Europe- the company simply says pending but issues weak statement presently just saying open not yet approved *****

So where does that put us here: litigation is lengthy and uncertain. I believe they should win but appeals have less than a 7% chance of reversal. So be real, even if they litigate, take the fight to the courts, stretch it out, the reality is in the US it boils down to the question maximize sales for next 1-2 years while building market, playing into generic hands? That’s exactly what generics want/expect

OR make the really hard decision to tumbleweed US, let it fade while fighting in court and look to monetize Europe/RoW?

As I see it that is the crux of the future and most important decision of this company now. If they drag this on, cry foul, then likely signals they are so immersed in shock that they will be too slow to refocus attention on Europe. This is like war now. Pardon the euphemism but if America is lost the worse thing to do is nurture the loss but instead fight for what’s ahead. Blitz for Europe/RoW. I don’t want to be left holding the bag of a company that will be slow to redirect focus. If they get stuck in this rut, fight, litigate, courts, blah, blah, blah and slowly act international then it will be a happy ending only for generics and bag holders will be left scrambling

That’s the honest to goodness truth here. It’s ugly, it’s hard to swallow but international is now the key. We know Amrn has always said partnering is preferred now instead of partnering they can silver platter it w the US litigation as a sour cherry on top of any bo talk.s.

Be aggressive now. Be laser focused on what’s next for Europe/rest of world.

Suck up the loss. What’s done is done. Now get on with it. Going get tough mentality.

As much as I want heads to roll, that won’t solve this crisis so what they do next matters.

I’ve expressed my concerns to them, predictably no response yet. For any of you still reading I urge you to email IR, voice demands. Voice action, let them know you won’t sit idly by with Europe open and untouched. Our best hope is Europe gets a bidding war. Someone will want it. Someone will pay for a Europe empire. Be smart, this is last leverage now.
