If I’m JT what I do now is this

In public, fight, make it seem like you will appeal like crazy. And they will appeal, if nothing else for stall tactics to delay generic entry. Then injunction, appeal, etc. but by no means spend $ to develop US.

Analogous to a big skyscraper going up but stop building the 4th floor even though the plan is 80 stories up. Let it be. Fight, fight, fight or least go through the motions of doing so.


Then contemplate offensive buyout strategy . Here this is what makes or breaks the company

Do they get aggressive, publicly saying we intend to sell, maximizing shareholder value, etc, trying to create bidding war

OR do they use behind the scenes approach trying to get BP to bite? This is the crux of where this company is now

Fighting to reverse Du is less than a 7% chance of reversal

JT is a bean counter, play the #s,the smart move now is buyout
