Anything is possible. The case can settle at any time, even if we go all the way through verdict, post-trial motions, judgment, and up on appeal, as the federal courts have a mediation program.

We do not have any hard data on the parties' respective settlement decisions. We do not know how far apart they may have been, or the reasonableness of each side's respective settlement positions.
