I hope I never see Actipatch on Walmart or CVS shelves.

Reminiscent of Stalinist Russia, when former co-conspirators would disappear overnight and their faces removed from photographs as if they had never existed. Suddenly all the previous hoopla expressed over the growing test run in CVS is to be forgotten, along with the possible presentation to WalMart for retail space, and Walgreen's due to its association with Boots. All now down the memory hole.... It's all about OEM as if retail were never considered.

What gives a product or service value is exclusivity.

Why would a world class company like DJO global enter into an exclusive agreement with Biel for their
technology when it could be bought at a discount on a Walmart shelf ?

Really? But BIEL is in discussions with multiple companies, not just one, so exclusivity in that sense is not in play.

These deals have brought comparisons to INTEL having its chips installed in OEM systems. But we know INTEL chips are in multiple computer systems from numerous manufacturers, AND INTEL chips can be purchased on their own via retail outlets for people who build their own systems. In the same way, BIEL could license technology to be used in other products while still offering ActiPatch in retail space.

.Marketing Actipatch on retail shelves lessons it’s intrinsic value and reduces it to a gizmo.

Really? Does the presence of acetaminophen on OTC shelves make it a 'gizmo', though it is routinely used in pain relievers available only by prescription?

How did ActiPatch suddenly go from a product predicted to 'fly off the shelves' to being simply a 'gizmo'? That indicates that the technology is great, but the actual ActiPatch is nothing but a gadget, regardless of whether the tech is used in the OEM stream. With all the posted testimonials relative to the product's effectiveness, suddenly it's just a 'gizmo'?

The elephant in the room, based in your questions, is whether or not BIEL products are unmarketable gadgets, and the only true value is in the underlying technology itself.
