Been reading/learning from this excellent board for a while, first time posting...

One point I would like to solicit opinions on, that I have not seen discussed on the board re. potential BO offer prior to settlement/resolution of litigation, since I continue to read some chatter/hope about this.

Price discovery for a potential BP buyer would of course be one issue and thats been acknowledged by most here, not the topic here. But the other issue I see is the political/regulatory ramifications for a BP to make an offer on AMRN prior to litigation resolution. Any offer, fairly or unfairly, would cast suspicions that it will then use its muscle to either force a settlement with generics or most importantly, any settlement with generics might be seen as a pay for delay by that BP. In other words, for a BP to become involved with AMRN prematurely might create a political/regulatory mess - in fact even discussions between BP and AMRN prior to a litigation settlement, then the settlement followed by a BO might cast suspicions by regulators later that the BP interfered unlawfully - e.g. BP insinuating a higher price tag for the soon to come BO if AMRN simply settles the case with generics that involves a pay for delay. Hope I am explaining this right, but I think it would be a lot cleaner for BP to steer clear until resolution of litigation.
