So, if I am understanding you correctly, your lawyer received material, non-public information from this company, and his response was to tell you to either keep your shares for a lawsuit or simply trade and take the loss. What lawyer would be ok saying "its your choice to commit insider trading". It would seem that most lawyers would advise you of the pitfalls of trading based on this information. Am I understanding you wrong? Who is your attorney?
