I think it’s more complicated than that. If defendants get those communications with FDA where Amarin effectively says “Reduce-It results are made more valid by the fact that a similar study (Jelis) yielded similar results”, then defendants will pull out that argument at the moment in the trial when Amarin is arguing that Jelis was a flawed trial, and therefore cannot be relied on to demonstrate obviousness. Defendants will argue that Amarin can’t have it both ways.
