The FDA is a big hurdle, yet it’s possible that most states could have their own CBD laws before the FDA comes out with a rule. Each state that sets its own laws locks in revenues. Vit Shoppe is selling our top selling supplements at my local mall because of Texas’ HB 1325. Businesses are making decisions based on state laws —not FDA opinion. State laws have already locked in a pathway for our products. The FDA rule is still important in the way that they will set ground rules for safety, but states are already doing that. The clock is ticking, and each passing moment will lead to either another state or the FDA creating more value for legitimate players. Barriers to entry will be and are being raised.
