You seem to think Samantha got up on the morning of the 3rd of December (3 weeks after the Initial Decision) and just decided to file the petition....on a whim.

Really??

That’s a theory.

Here’s a better one.

Samantha DID go to her “Boss”. They discussed this insane and shocking decision of Foelak’s.

I’m sure other conversations with other people took place there at the SEC. MUCH higher up than Samantha and her “boss”!

These discussions involved talks about whether or not a petition for review had a chance to be approved.

Do you REALLY think she would have even BOTHERED to file the petition if those above her thought it was frivolous? That it didn’t have a good chance of success?

Don’t you think that her “Boss” would have said :

“Sam, don’t bother. This company is a habitual offender. It will only be a short time before they run afoul of compliance again. We’ll deal with them again when that happens” ....

....if her “boss” had not received word from above that filing the petition had a good chance of succeeding?

I don’t think the SEC would waste it’s time filing a Petition for Review if they thought it would fail approval by the board of Commissioners.

Get ready. I think this petition for review will be approved.
