COMES NOW, PROCOPIO CORY HARGREAVES & SAVITCH LLP (“Procopio”)
hereby moves this Court for an order allowing Procopio to withdraw as attorneys of record for
Defendants MICHAEL MONA JR. and MICHAEL MONA III (the “Monas”) only. This Motion is
made and based upon the following Memorandum of Points and Authorities, the Declaration of S.
Todd Neal, Esq. in support ofthis Motion, and any oral argument this Court may allow at the time
of hearing.

DECLARATION OF S. TODD NEAL, ESQ. IN SUPPORT OF MOTION
TO WITHDRAW AS TO THE MONA DEFENDANTS ONLY
S. TODD NEAL, ESQ., declares, pursuant to 28 U.S.C. § 1746 and NRS § 53.045, under
penalty of perjury, that the following is true and correct:
1. I am over the age of 18 years and have personal knowledge of the facts stated
herein, except those stated upon information and belief, and as to those, 1 believe them to be true. I
am competent to testify as to the facts stated herein in a court of law and will so testify if called
upon.
2. I make this Declaration in support of Procopio’s Motion to Withdraw as Counsel of
Record for Defendants MICHAEL MONA JR. and MICHAEL MONA III.
3. The Motion to Withdraw is based upon the decision by CV Sciences and the Monas
mutual decision to divest their business and legal interests.
4. CV Sciences and the other named defendants shall continue to be represented by
Procopio with the Monas continuing to be represented by Marquis Aurbach Coffing.
5. The Monas have been notified of Procopio’s intent to withdraw, and Procopio has
received no opposition to such intent.

7. The Monas are currently facing no pending deadlines in this matter and the
withdrawal will not affect any scheduled trial date or other litigation deadlines.
8. After communicating with Marquis Aurbach Coffing, we are informed that the
Monas make no opposition to this withdrawal.

9. As such, a request is hereby made for an order from this Court allowing Procopio to
withdraw as counsel ofrecord for the Monas in this matter.
