Most companies don’t file for 5 years and don’t get any OIP. DBMM got OIP because of Asher and there were circumstance as to why DBMM were not able to file for less than 2 years of reports. Read those circumstances.
And who said company can’t WIN Section(12) j case ? Show me a SEC link to that saying no company can win if they don’t file for sometime.
There are rules AL Judges follow. Judge Carol followed the law. OIP was sent on DBMM as it did not file. Later DBMM filed all reports and got audited, so investors knows the fins and are protected so OIP dismissed.
Need SEC links where SEC itself filed the motion to dismiss just because the company filed all its reports ?
