The company likely tried to buy themselves time so they could deliver the games, but it just took too long for morning to get their act together, now they have to give the money back.
Lawsuits (disagreements) happens Often in business, esp when you reach this size.... Unfortunately this was just due to timing/delays.
Morning/FUNN might have also felt that this other company understood that these games were not complete when they placed their order, which is why they held off on giving the money back. if something is not complete, you can’t be sure it’s going to be there by a certain date. I bet you this is the issue/confusion
