The standards may help in determining whether an IPR holder should get paid but I don't believe the standards will help in determining how much or a rate in which a holder will get paid.

Before the ERICSSON settlement we were throwing numbers around from .75% all the way to 2% in regards to 2G licensing. I do not recall anyone thinking that .4% to .5% would be what IDCC would settle on. So when the .4 to .5 number happened I figured at least it was low enough for NOKIA to accept right.

Well NOKIA is balking and so their little Mini-Me (SAMSUNG).
As we all know they are taking the argument that ERICSON/SONY is not a trigger. So what rate would make NOKIA happy? .3, .2, .1?

The facts as I see them is that these companies are using the legal system as road blocks to prevent inventors from receiving their fair rewards for their creations. The fact that NOKIA wants to delay, unseal and fight proves that they will go to any lengths to not pay.

Basically, I just can't see how IDCC will collect fair royalty rates without a fight.
