You have to find out who is the Standard Setting Organization (SSO) for Docsis 3.0/3.1 technology. They would have to declare that Chanbond's patents are SEP's to the standard. Then Chanbond would have to offer the patents to those using their tech on a FRAND(Fair Reasonable and Non Discriminatory) basis. Dont think this was ever pursued by Chanbond, choosing patent infringement actions against selected infringers instead.
