How do you defend patent infringement by claiming a proposed label won't violate patents? There's no guarantee they would actually seek this proposed label or that the FDA would accept it - in reality it doesn't exist. And IRL the actual label won't mean squat - if docs are aware of generic V, they'll prescribe it for the R-IT indication off label - can't see how generics win this case.
