Not only is hemp derived THC just as federally legal as hemp derived CBD, but hemp derived THC (and all other hemp derived cannabinoids) have the additional benefit of not being ingredients in FDA approved drugs.

It is the CBD content that could keep you from calling your product a food or dietary supplement. There is no IND preclusion for hemp derived THC or any other hemp derived cannabinoids. They are not drugs or controlled substances under any Federal definitions.
