IMO- def14c filing reads "before Sept. 30". So, it could mean they would have to file Notice of Action w finra before the 30th. And an action notice can be done up to 10 business days in advance of the scheduled execution.

since they would need to be compliant first, they would need to obtain complaint status within the 10 business day action notice window. otherwise finra won't approve it. this is assuming of course, finra would even accept an action notice from a non complaint company.

granted, i am just speculating an oddball scenario here- to me it seems highly unlikely - so i would expect a new set of pre filings some time after the fins come out, after they get back to a compliant status.
