The Collins plaintiffs want three things: NWS ended, seniors extinguished, $25B tax (or other prepayment) credit with Treasury.

A settlement necessarily involves the plaintiffs not getting everything they want. If Treasury offers the first two things but wants to keep some or all of that $25B free and clear (i.e. without granting a prepayment credit for it), that sounds like a compromise to me. Not the attorneys laying down.
