1. Plaintiff’s Statement
Plaintiff anticipates that it will conduct discovery to determine whether Defendants’ infringement was limited to their promotional and advertising activities only, or whether they also sold or offered for sale competing amorphous metal products. Specifically, evidence of the sale or offer for sale of competing amorphous metal products may give rise to additional claims against Defendants, such as breach of the non-disclosure agreement and/or misappropriation of trade secrets. Though Plaintiff presently does not intend to name any additional defendants to this action, investigations are ongoing and additional defendants may be identified through the discovery process.
