1:45 Upon close of initial mortgage, a note (asset) was also created and a bond was created that was unsecured
Federal Reserve gave the orginating bank a credit of 10 times the amount of the note
Then the bank sold the mortgage but the note was decoupled from the mortgage
The mortgage was then eventually sold to MBS Trusts

5:15 Certificates were sold to investors, and the money from the sold certificates were given to the orginating bank so they can loan the money to the borrowers

6:47 Pooling and Servicing Agreement: If mortgages went into default (CDS would be paid to the MBS Trusts).
AIG (Insurance company) wouldn't pay out the CDS until the 91st day late . Payoff would be triggered and the MBS Trusts would get the full amount of the note!

8:55 Federal Reserve allowed the MBS Trusts to leverage the note 30 times the amount of the note

9:25 AIG (insurance company) paid off the full amount of the note when the mortgage payments were 91 days late.

11:37 MERS (Mortgage Electronic Records System) was in most cases trying to foreclose as a nominee lender because MERS takes possession of the mortgage only.
MERS believed that the Note followed and was coupled with the mortgage

12:34 US Supreme Court in 1872, stated that if the Note and the Mortgage are separated (because one secures the other) then they are both null and void.

13:14 Kansas Supreme Court ruled that MERS was not a lender.

13:22 Chain of title was broken because the Mortgage and Note was separated or decoupled at the closing of the initial mortgage.

IMO...my conclusions as of September 10, 2019:

1) Mortgages and Notes were separated from the closing of initial closing of mortgages, thus having a defective chain of title from the start.

IMO...If you believe that there was a defective chain of title from the beginning then this would mean that all of the loans originated from WMI subsidiaries would still technically have those originating lenders as the owners of the mortgages. Thus the rightful owners of $692 billion in securitizations belong to WMI subsidiaries/WMI Escrow Marker Holders.

2) AIG and other insurance companies would payout the Credit Default Swaps once mortgage payments for 91 days in default, thus the full amount of the note would be paid out to the Trustees of the MBS Trusts.

3) The Underwriters knew of the securitization scheme from the beginning and that's why they are fighting so hard to keep their Class 19 claims.

Underwriters' Class 19 Claims = 1% of Class 19 recoveries

If recoveries are $692 billion

$692 billion x 75% = $519 billion for Class 19 recoveries

$519 billion x 1% = $5.19 billion for Underwriters' Class 19 claims

Thus potential recoveries to Underwriters' = $5.19 billion for an indemnification claim of $96 million.
