When you think about IDCC's strategy is pretty good.

They need 2 rates to be established to collect royalties from all the wireless players.

First the 2 and 2.5g rates. This mess got cleaned up good by the ERICSON settlement. Basically setting a firm date of Jan 1 2002 and a firm rate of .5%. Put everything behind and force others to abide by this agreement.

Next 3G. The NEC deal was the key. The 1.5% sets the base for all others to follow. Now if they go to court and win, a court can easily grant them the 1.5% NEC is paying plus damages.

The problem with the company in the past is negotiating from weakness instead of strength. It needed NOKIA and the $57 million to survive. With the company flush with cash and licenses it can now be less tolerant during these negotiations and can pull the court card faster.

Think about it, the only reason anyone would pay royalties on IPR is if they were worried about a law suit. That is why we have to take out the HAMMER and force the 1.5% down infringers throats.
