It is contingent on collecting the $2.4M default judgment I believe. $BRKK either collects on the $2.4M judgment thus triggering a $1.2M share buyback. Or they fail to collect the $2.4M judgment and that particular $1.2M share buyback doesn't happen. There is nothing sinister about it.
