Based on your post, it does appear that the UW's will be afforded full Preferred Equity treatment.

IF there is cash available after Class 18 is paid, they will share in distributions to Preferred Equity.

A minimum of $10B is required for them to receive their full $72M claim, anything less makes this designation moot.

As things stand currently before the courts, there is nothing left, making payment of the UW's claim unrealistic.

Do you actually believe there is more than $10B in cash available for this to even become an issue???
