I assume that you are referring to the transcript attached to the division’s cross motion. The testimony regarding settlement that I found was simply a brief reference to the parties attempt to settle the matter, which attempts clearly were unsuccessful.

I would love to see a settlement negotiated between the parties, but I have my doubts that it will come to that. Typically, parties will fully explore settlement options prior to putting the matter for a decision by the judge. If a settlement could not be reached prior to this point, then the chance of the parties settling after all of the work is done and the matter is pending for a decision, is less likely, but still possible.

I personally believe that a decision is still going to be issued by the judge. How long it takes to issue that decision may be dependent upon the judge’s case load. It can take a few months for a decision to be issued.

The bottom line is that DBMM has now filed the missing financial records with the division. I remain confident in our chances here, whether the final disposition comes through settlement or a decision by the judge. My preference would be through a settlement, because that would take it out of the discretion of the judge. Judges can be unpredictable and can surprise with their rulings. I hope we hear something soon. That was a very good catch by you, finding that testimony. Thanks for sharing.
