I'm not sure I agree it's a patent infringement. "Pharmaceutical grade" does not have to mean it is FDA approved and Amarin certainly doesn't have a patent on words.

I don't know the law on claiming something is pharmaceutical grade or how the FDA would treat such language, but I don't see any conflict with our patents. They are simply claiming it is pharmaceutical grade. Many things can be of the same quality as FDA approved pharmaceuticals without having been FDA approved. Notwithstanding this comment, I would be surprised if the FDA still does not have regs on advertising to this extent.

I'm not arguing for the sake of arguing with you. I'm just being objective about the language.

Is there a specific patent you believe this innfringes?
